The Legal Process Explained

The process for divorce and civil partnership dissolution is now more straightforward under the Divorce, Dissolution and Separation Act 2020. With the no-fault system in England and Wales, there is no need to assign blame or prove wrongdoing — the focus is simply on confirming that the relationship has broken down and moving forward.

Here to Guide You Through Every Step

There are five key stages in divorce or civil partnership dissolution, and we’re here to support you through each one. With clear advice, calm guidance, and care for your individual circumstances, we’ll help you feel informed, prepared, and confident as you move forward.

Step 1: Application

The process begins with an application to the court, made either by one person (a sole application) or together (a joint application). You simply confirm that the marriage or civil partnership has irretrievably broken down — there is no need to explain why or assign blame.

We’ll help you prepare and submit the application correctly, keeping the process clear and manageable from the start so you know exactly what to expect.

Step 2: Acknowledgement

If a sole application is made, the court sends a copy to the other person (the respondent), who must confirm receipt by returning an Acknowledgement of Service form within 14 days.

We’ll keep you updated and handle any delays or issues, ensuring the process continues smoothly without unnecessary hold-ups.

Step 3: Reflection Period

Once the application is acknowledged, a 20-week reflection period begins. This time is designed to allow both partners to consider the future, make arrangements for finances and children, and prepare for the next stage.

We’ll be here throughout to offer support and guidance, helping you use this period to make clear and practical decisions.

Step 4: Conditional Order

After the 20-week period, you can apply for a Conditional Order. This is the court’s confirmation that there is no legal reason the divorce or civil partnership dissolution cannot go ahead.

We’ll take care of the paperwork and explain what this stage means for your financial arrangements, parenting plans, and the steps that follow.

Step 5: Final Order

Six weeks after the Conditional Order, you can apply for the Final Order. This is the final legal step, and once granted, your divorce or civil partnership dissolution is complete.

We’ll ensure everything is finalised properly and support you with any follow-up steps, such as updating your Will or financial arrangements, so you can move forward with certainty.
