Understanding Powers of Attorney & Court of Protection

Powers of Attorney and the Court of Protection both allow someone to act on behalf of another person, but they work in different circumstances. A Power of Attorney is arranged while you still have capacity, while the Court of Protection steps in if no such arrangements are in place.

Ordinary Power of Attorney

An Ordinary Power of Attorney allows you to appoint someone you trust to manage your financial affairs for a set period or purpose. This is often useful if you are unwell or abroad for an extended time. It can be cancelled at any point, but it automatically ends if you lose mental capacity. This makes it most suitable for temporary or short-term arrangements where you can still oversee the decisions being made on your behalf.

Lasting Power of Attorney

A Lasting Power of Attorney (LPA) remains valid even if you later lose the capacity to make decisions. There are two types: one covering health and welfare decisions, and one covering property and financial matters. Court of Protection Applications

If someone can no longer manage their affairs and has no valid LPA in place, the Court of Protection can appoint a Deputy to make decisions for them.
